A debt solution or bankruptcy should only be used as a last possible solution in any case. The problem with this kind of solving problems of debt is that this includes a lot more than just eliminating debt like that simple. If a person declares he’s bankrupt, all debt collections against that person will be prevented. The court will grant an automatic stay, which means that creditors can’t come after their money you owe to them.
An important exception is when a loan gets secured by property creditors and can seek relief from that and will seize that specific property. Exceptions are student loan debts, taxes, child support and alimony. The drawback for the person who will seek this solution to get free from debt problems is that he must give away all non – exempt property to the creditor. This property will be sold and the income will be given to the creditors.
There are two kinds of these solutions when encountering the debt problems
Chapter 7
This states that the person must hand over some of their property, but the creditor won’t be able to ask money from their further income
Chapter 13
This will allow the person to keep their income, but will have to make a plan to pay the debt back based on their future income to the creditors. With this plan, the court is able to require people to live with strict budget.
It is obvious now that there are drawbacks for both debt elimination programs. One of the biggest is that both plans will have a major impact on a person’s credit rate. Because of this, you would want to reconsider filing for bankruptcy. Other kinds of debt solutions like debt counseling, debt consolidation, debt management and debt negotiation are recommended to by a first option than bankruptcy.
Sadly, there are more disadvantages than advantages if you declare yourself bankrupt. You should avoid this as long as possible. Bankruptcy should be your very last solution.
